Giri\u015f\ufeff<\/strong><\/p>\n\n\n\n<p>31 Aral\u0131k 2019 g\u00fcn\u00fc \u00c7in\u2019in Wuhan\nkentinde ortaya \u00e7\u0131kan ve k\u0131sa s\u00fcrede t\u00fcm d\u00fcnyaya yay\u0131larak bir\u00e7ok can kayb\u0131na\nsebep olan (COVID-19) t\u00fcm d\u00fcnyan\u0131n g\u00fcndemi haline gelmi\u015f olup, \u00fclkemizde de ilk\nvaka 10.03.2020 tarihinde tespit edilmi\u015ftir. <\/p>\n\n\n\n<p>D\u00fcnya Sa\u011fl\u0131k \u00d6rg\u00fct\u00fc (W.H.O.) 11 Mart\n2020 tarihinde bu vir\u00fcs\u00fc \u2018\u2019Pandemi\u2019\u2019 olarak ilan etmi\u015f<a href=\"#_ftn1\">[1]<\/a>\nve t\u00fcm d\u00fcnyada h\u00fck\u00fcmetler vir\u00fcs\u00fcn yay\u0131lmas\u0131na engel olmak ad\u0131na, \u00e7e\u015fitli\nalanlarda bir\u00e7ok tedbir almaya ba\u015flam\u0131\u015ft\u0131r. \u00dclkemizde de ilk vakan\u0131n tespitinin\nard\u0131ndan, &nbsp;\u00f6ncelikle e\u011fitim ve \u00f6\u011fretime\nara verilmi\u015f di\u011fer bir\u00e7ok alanda da baz\u0131 tedbirlere ba\u015fvurulmu\u015ftur. Bir\u00e7ok\ni\u015fletmenin kapat\u0131lmas\u0131na karar verilmi\u015f, 65 ya\u015f \u00fcst\u00fc ve 20 ya\u015f alt\u0131\nvatanda\u015flar\u0131m\u0131z i\u00e7in soka\u011fa \u00e7\u0131kma yasa\u011f\u0131 ilan edilmi\u015ftir. Di\u011fer t\u00fcm vatanda\u015flar\ni\u00e7in ise zorunlu kalmad\u0131k\u00e7a soka\u011fa \u00e7\u0131kmamalar\u0131 y\u00f6n\u00fcnde \u00e7a\u011fr\u0131larda\nbulunulmu\u015ftur.<\/p>\n\n\n\n<p>T\u00fcm bu geli\u015fmeler her alanda oldu\u011fu\ngibi \u00e7al\u0131\u015fma hayat\u0131nda da etkilerini g\u00f6stermi\u015f, bir\u00e7ok sekt\u00f6r salg\u0131n\nhastal\u0131k nedeni ile i\u015f yapamaz hale gelmi\u015ftir. Hal b\u00f6yle iken faaliyetlerini\ndurduran veya \u00f6nemli \u00f6l\u00e7\u00fcde azaltan i\u015f yerlerinde \u00e7al\u0131\u015fmakta olan i\u015f\u00e7ilerin i\u015f\ns\u00f6zle\u015fmelerinin ak\u0131betinin ne olaca\u011f\u0131, bu durumun i\u015f\u00e7i-i\u015fveren ili\u015fkisini nas\u0131l\netkileyece\u011fi \u00f6nem kazanm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Yapm\u0131\u015f oldu\u011fum bu \u00e7al\u0131\u015fmada bu s\u00fcrecin i\u015f s\u00f6zle\u015fmeleri \u00fczerindeki etkileri ve i\u015fverenin bu s\u00fcre\u00e7te izleyebilece\u011fi yollar incelenecektir.&nbsp;<\/p>\n\n\n\n<p><strong>2. \u0130\u015fin Tamamen veya K\u0131smen Durdurulmas\u0131 <\/strong> <\/p>\n\n\n\n<p>\u00d6ncelikle\u0130\u00e7i\u015fleri\nBakanl\u0131\u011f\u0131 Covid-19\u2019un \u00fclkemizde g\u00f6r\u00fclmesi ile hastal\u0131\u011f\u0131n bula\u015fmas\u0131 y\u00f6n\u00fcnden\ny\u00fcksek tehlike arz eden bir\u00e7ok i\u015f yerinin kapanmas\u0131n\u0131 \u00f6ng\u00f6ren genelgeler\nyay\u0131nlam\u0131\u015f, yay\u0131nlanan bu genelgeler ile \u201c<em>gece kul\u00fcpleri, bar, pavyon, diskotek, tiyatro, sinema, g\u00f6steri merkezi,\nkonser salonu, ni\u015fan\/d\u00fc\u011f\u00fcn salonu, \u00e7alg\u0131l\u0131\/m\u00fczikli lokanta\/kafe, gazino,\nbirahane, taverna, kahvehane, k\u0131raathane, kafeterya, k\u0131r bah\u00e7esi, nargile\nsalonu, nargile kafe, internet salonu, internet kafe, her t\u00fcrl\u00fc oyun salonlar\u0131,\nher t\u00fcrl\u00fc kapal\u0131 \u00e7ocuk oyun alanlar\u0131 (AVM ve lokanta i\u00e7indekiler d\u00e2hil), \u00e7ay\nbah\u00e7esi, dernek lokalleri, lunapark, y\u00fczme havuzu, hamam, sauna, kapl\u0131ca, masaj\nsalonu, SPA ve spor merkezleri\u201d<\/em> olmak \u00fczere toplam 149.382 i\u015f yerinin<a href=\"#_ftn2\">[2]<\/a>\nfaaliyetlerine ge\u00e7ici olarak ara verilmi\u015ftir. Bakanl\u0131k karar\u0131 ile ge\u00e7ici olarak\nkapat\u0131lan bu i\u015f yerleri d\u0131\u015f\u0131nda yapm\u0131\u015f olduklar\u0131 i\u015fin maiyeti gere\u011fi kendi\nkarar\u0131 ile de bir\u00e7ok i\u015f yeri \u00e7al\u0131\u015fmalar\u0131na ge\u00e7ici olarak tamamen ara\nvermi\u015flerdir.<\/p>\n\n\n\n<p>Bu i\u015fyerlerinin yan\u0131 s\u0131ra \u00fclkede \u00fcretimin durmamas\u0131 ad\u0131na faaliyetlerini devam ettirmek zorunda olan bir\u00e7ok i\u015f yeri de \u00e7al\u0131\u015fmalar\u0131n\u0131 uzaktan y\u00fcr\u00fctme karar\u0131 alm\u0131\u015f veya \u00e7al\u0131\u015fma saatlerini azaltma, vardiyal\u0131 \u00e7al\u0131\u015fma vb. alternatif \u00e7al\u0131\u015fma d\u00fczenleri \u00fcreterek, bu s\u00fcrecin olumsuz etkilerini bertaraf etmeye \u00e7al\u0131\u015fmaktad\u0131rlar.<\/p>\n\n\n\n<p><strong>3. Covid-19 Salg\u0131n S\u00fcrecinde \u0130\u015fverenin \u0130zleyebilece\u011fi Yollar<\/strong><\/p>\n\n\n\n<p>\u0130\u015f hayat\u0131nda meydana gelen bu de\u011fi\u015fiklerin i\u015f\u00e7i-i\u015fveren ili\u015fkisini \u00f6nemli \u00f6l\u00e7\u00fcde etkileyece\u011fi a\u00e7\u0131kt\u0131r. \u0130\u015f yerindeki \u00e7al\u0131\u015fmalar\u0131n tamamen durdurulmas\u0131 veya \u00e7al\u0131\u015fmaya farkl\u0131 yollarla devam edilmesi y\u00f6n\u00fcndeki kararlar do\u011frultusunda i\u015f s\u00f6zle\u015fmeleri y\u00f6n\u00fcnden i\u015fverenin farkl\u0131 kararlar alma imk\u00e2n\u0131 bulunmaktad\u0131r. Bu kararlar a\u015fa\u011f\u0131da ayr\u0131nt\u0131l\u0131 olarak incelenecektir: <\/p>\n\n\n\n<p><strong>3.1. \u0130\u015f\u00e7inin \u00dccretsiz \u0130zne \u00c7\u0131kart\u0131lmas\u0131 <\/strong><\/p>\n\n\n\n<p>4857&nbsp;Say\u0131l\u0131\n\u0130\u015f Kanunu 56. ve 74. maddelerinde baz\u0131 \u00f6zel durumlara mahsus olmak \u00fczere i\u015f\u00e7iye\nhak olarak verilen \u00fccretsiz izinler d\u00fczenlenmi\u015ftir. Ancak bunun d\u0131\u015f\u0131nda genel\nolarak \u00dccretsiz\n\u0130zin&nbsp;kavram\u0131n\u0131n tan\u0131m\u0131 ve nas\u0131l kullan\u0131laca\u011f\u0131 ile ilgili mevzuat\u0131m\u0131zda herhangi\nbir d\u00fczenleme bulunmamaktad\u0131r. &nbsp;Bu\nnedenle uygulamada ortaya \u00e7\u0131kan uyu\u015fmazl\u0131klar neticesinde \u00fccretsiz izin\nkullan\u0131m\u0131na ili\u015fkin esaslar y\u00fcksek mahkeme kararlar\u0131 ile belirlenmi\u015ftir. <\/p>\n\n\n\n<p>Yarg\u0131tay kararlar\u0131\nile \u00fccretsiz izinlerin taraflar\u0131n r\u0131zas\u0131yla kullan\u0131lmas\u0131 gerekti\u011fi a\u00e7\u0131k\u00e7a\nbelirtilmi\u015f ve i\u015f\u00e7inin yaz\u0131l\u0131 r\u0131zas\u0131 olmaks\u0131z\u0131n, kendisine \u00fccretsiz izin kulland\u0131r\u0131lamayaca\u011f\u0131\nbenimsenmi\u015ftir. \u0130\u015f\u00e7inin r\u0131zas\u0131 olmadan bu y\u00f6nde uygulamaya gidilmesi Yarg\u0131tay\ntaraf\u0131ndan eylemli fesih olarak kabul\nedilmi\u015f, i\u015f\u00e7i a\u00e7\u0131s\u0131ndan i\u015f akdinin haks\u0131z fesih halini olu\u015fturdu\u011fu kabul\nedilmi\u015ftir. <a href=\"#_ftn3\">[3]<\/a> <a href=\"#_ftn4\">[4]<\/a><\/p>\n\n\n\n<p>Bu uygulama\ndo\u011frultusunda bu s\u00fcre\u00e7te de, i\u015f\u00e7ilerin \u00fccretsiz izin kullanmas\u0131 onlar\u0131n buna yaz\u0131l\u0131\nr\u0131za vermesi ile m\u00fcmk\u00fcn olmas\u0131, aksi halde bunun i\u015fveren taraf\u0131ndan i\u015f akdinin &nbsp;tek tarafl\u0131 haks\u0131z nedenle feshi niteli\u011finde\nolmas\u0131 gerek iken; 17.04.2020 tarihli 7244 Say\u0131l\u0131 \u201c<strong><em>Yeni\nKoronavir\u00fcs (Cov\u0131d-19) Salg\u0131n\u0131n\u0131n Ekonomik ve Sosyal Hayata Etkilerinin\nAzalt\u0131lmas\u0131 Hakk\u0131nda Kanun ile Baz\u0131 Kanunlarda De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair\nKanun<\/em><\/strong><strong>\u201d\n<\/strong>nun 9.\nmaddesi ile 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019na GE\u00c7\u0130C\u0130 10. MADDE<a href=\"#_ftn5\">[5]<\/a> eklenmi\u015f\nve &nbsp;bu madde ile i\u015fverenin, bu kanunun\ny\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten itibaren 3 ay s\u00fcre ile \u0130\u015f Kanunu\u2019nun 25\/II. maddesi haricinde\ni\u015f akitlerini sonland\u0131ramayaca\u011f\u0131 ve ayn\u0131 zamanda i\u015fverenin i\u015f\u00e7inin r\u0131zas\u0131\naranmaks\u0131z\u0131n yine bu kanunun y\u00fcr\u00fcrl\u00fck tarihinden itibaren 3 ayl\u0131k s\u00fcre ile\ni\u015f\u00e7iyi k\u0131smen veya tamamen \u00fccretsiz izne \u00e7\u0131kartabilece\u011fi kararla\u015ft\u0131r\u0131lm\u0131\u015ft\u0131r. <\/p>\n\n\n\n<p>Yine ayn\u0131 kanunun 7. Maddesi ile\n4447 Say\u0131l\u0131 Kanun\u2019a GE\u00c7\u0130C\u0130 24. MADDE<a href=\"#_ftn6\">[6]<\/a>\neklenmi\u015f ve bu madde ile de \u00fccretsiz izne \u00e7\u0131kart\u0131lan ve &nbsp;i\u015f yerinde k\u0131sa \u00e7al\u0131\u015fma ba\u015fvurusu yap\u0131lmas\u0131na\nra\u011fmen k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011finden yararlanamayan i\u015f\u00e7ilere g\u00fcnl\u00fck 39,24 TL nakdi\n\u00fccret deste\u011fi verilmesi ve bu i\u015f\u00e7ilerin genel sa\u011fl\u0131k sigorta primlerinin\n\u00f6denece\u011fi kararla\u015ft\u0131r\u0131lm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Bu yap\u0131lan yeni d\u00fczenleme ile i\u015fveren i\u015f\u00e7iyi r\u0131zas\u0131n\u0131 almaks\u0131z\u0131n \u00fccretsiz izne \u00e7\u0131kartabilecektir. &nbsp;Her ne kadar bu madde ile \u00fccretsiz izne \u00e7\u0131kart\u0131lan ve k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011finden faydalanamayan i\u015f\u00e7ilere gelir sa\u011flanm\u0131\u015f olsa da; sa\u011flanan gelirin miktar\u0131n\u0131n azl\u0131\u011f\u0131n\u0131n ve i\u015fverene k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011fine ba\u015fvuru yapma \u015fart\u0131 getirilmeksizin i\u015f\u00e7inin r\u0131zas\u0131n\u0131 almadan i\u015f\u00e7iyi \u00fccretsiz izne \u00e7\u0131karma yetkisi verilmesinin i\u015f\u00e7inin bu s\u00fcre\u00e7teki ma\u011fduriyetini gideremeyece\u011fi a\u00e7\u0131kt\u0131r. <\/p>\n\n\n\n<p><strong>3.2. \u0130\u015f\u00e7iye \u00dccretli Y\u0131ll\u0131k \u0130zinlerinin Kulland\u0131r\u0131lmas\u0131 <\/strong><\/p>\n\n\n\n<p>4857\nsay\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 53. Maddesi uyar\u0131nca i\u015fyerinde i\u015fe ba\u015flad\u0131\u011f\u0131 g\u00fcnden\nitibaren, deneme s\u00fcresi de i\u00e7inde olmak \u00fczere, en az bir y\u0131l \u00e7al\u0131\u015fm\u0131\u015f olan\ni\u015f\u00e7iler yine bu maddede belirtilen s\u00fcrelerde<a href=\"#_ftn7\">[7]<\/a> y\u0131ll\u0131k\n\u00fccretli izne hak kazanmaktad\u0131r. Bu izinlerin ne zaman kullan\u0131laca\u011f\u0131na ili\u015fkin\n\u0130\u015f Kanunu\u2019nda bir d\u00fczenleme yer almamaktad\u0131r. Ancak Y\u0131ll\u0131k \u00dccretli \u0130zin\nY\u00f6netmeli\u011fi\u2019nin 5. maddesinde i\u015f\u00e7inin ne zaman y\u0131ll\u0131k \u00fccretli izin\nkullanaca\u011f\u0131na ili\u015fkin d\u00fczenlemenin y\u00fcr\u00fct\u00fclen i\u015fin nitelik ve \u00f6zelliklerine g\u00f6re\ni\u015fveren taraf\u0131ndan yap\u0131laca\u011f\u0131 a\u00e7\u0131k\u00e7a belirtilmi\u015ftir.<a href=\"#_ftn8\">[8]<\/a><\/p>\n\n\n\n<p>Yarg\u0131tay\nkararlar\u0131 ile de yine d\u00fcr\u00fcstl\u00fck kural\u0131 \u00e7er\u00e7evesinde i\u015f\u00e7inin y\u0131ll\u0131k izinlerini\nne zaman kullanaca\u011f\u0131n\u0131n i\u015fverenin takdirinde oldu\u011fu benimsenmi\u015ftir. &nbsp;<\/p>\n\n\n\n<p>Bu esaslar \u00e7er\u00e7evesinde, covid-19 salg\u0131n\u0131 sebebiyle i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ramayan i\u015fverenin bu \u00e7al\u0131\u015f\u0131lmayan g\u00fcnlerde i\u015f\u00e7ilere y\u0131ll\u0131k izinlerini kulland\u0131rma hakk\u0131n\u0131n oldu\u011fu a\u00e7\u0131kt\u0131r. \u0130\u015fveren bu s\u00fcre\u00e7te i\u015f\u00e7ilere y\u0131ll\u0131k izinlerini kulland\u0131rtabilecektir. \u0130\u015f\u00e7inin y\u0131ll\u0131k izne hak kazanmam\u0131\u015f olmas\u0131 halinde ise her iki taraf\u0131ndan da anla\u015fmas\u0131 ile avans y\u0131ll\u0131k izin kulland\u0131r\u0131lmas\u0131 da m\u00fcmk\u00fcn olacakt\u0131r. <\/p>\n\n\n\n<p><strong>3.3. \u0130\u015f\u00e7inin \u0130\u015f Akdinin Zorlay\u0131c\u0131 Sebeple Hakl\u0131 Nedenle Feshi <\/strong><\/p>\n\n\n\n<p>Bu s\u00fcre\u00e7te i\u015f\ns\u00f6zle\u015fmelerinin ak\u0131beti y\u00f6n\u00fcnden i\u015fverenin ba\u015fvurmak zorunda kalabilece\u011fi\nyollardan biri de i\u015f akdinin hakl\u0131 nedenle feshi olabilecektir. \u0130\u015fverenin i\u015f\ns\u00f6zle\u015fmesini feshedebilece\u011fi hakl\u0131 nedenlerin say\u0131lm\u0131\u015f oldu\u011fu 4857 Say\u0131l\u0131 \u0130\u015f\nKanunu\u2019nun 25. Maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda<em>\n\u201c\u0130\u015f\u00e7iyi i\u015f yerinde bir haftadan fazla s\u00fcre ile \u00e7al\u0131\u015fmaktan al\u0131koyan zorlay\u0131c\u0131\nbir sebebin ortaya \u00e7\u0131kmas\u0131\u201d<\/em> bu hakl\u0131 nedenler aras\u0131nda say\u0131lm\u0131\u015ft\u0131r. \u0130\u015f\u00e7iyi\nbir haftadan fazla bir s\u00fcre i\u015f yerinde \u00e7al\u0131\u015fmaktan al\u0131koyan sebepler, i\u015f\u00e7inin\ni\u015f akdinin hakl\u0131 nedenle feshine sebep olacak zorlay\u0131c\u0131 nedenler olarak kabul\nedilmektedir. Bu noktada ya\u015famakta oldu\u011fumuz s\u00fcre\u00e7te ilk de\u011ferlendirilmesi\ngereken husus bu pandeminin zorlay\u0131c\u0131 sebep olarak kabul edilip\nedilmeyece\u011fidir. <\/p>\n\n\n\n<p><strong>3.3.1. Covid-19 Salg\u0131n\u0131n Zorlay\u0131c\u0131 Sebep Kabul Edilip Edilemeyece\u011fi <\/strong><\/p>\n\n\n\n<p>Zorlay\u0131c\u0131 sebep\ns\u00f6zle\u015fme yap\u0131l\u0131rken \u00f6ng\u00f6r\u00fclemeyen, ortaya \u00e7\u0131kt\u0131\u011f\u0131nda direnilemeyen, bu itibarla\nda s\u00f6zle\u015fmenin ifas\u0131nda mutlak bir imk\u00e2ns\u0131zl\u0131\u011fa yol a\u00e7an harici bir olay olup ge\u00e7ici\nnitelikte ise, i\u015f s\u00f6zle\u015fmesini ask\u0131ya al\u0131c\u0131 etki g\u00f6sterir <a href=\"#_ftn9\">[9]<\/a> &nbsp;Ya\u015famakta oldu\u011fumuz bu salg\u0131n\u0131n \u00f6ng\u00f6r\u00fclemeyen,\ntaraflardan kaynaklanmayan bir niteli\u011fi oldu\u011fu ve ifa imk\u00e2ns\u0131zl\u0131\u011f\u0131na yol a\u00e7t\u0131\u011f\u0131\ng\u00f6z \u00f6n\u00fcnde bulunduruldu\u011funda zorlay\u0131c\u0131 neden kabul edebilece\u011fi a\u00e7\u0131kt\u0131r. <\/p>\n\n\n\n<p>Kald\u0131 ki; K\u0131sa\n\u00c7al\u0131\u015fma Y\u00f6netmeli\u011fi\u2019nin m. 3\/f. 1-h bendinde de &nbsp;zorlay\u0131c\u0131 sebep <em>\u201c\u0130\u015fverenin kendi sevk ve idaresinden kaynaklanmayan, \u00f6nceden\nkestirilemeyen, bunun sonucu olarak bertaraf edilmesine imk\u00e2n bulunmayan,\nge\u00e7ici olarak \u00e7al\u0131\u015fma s\u00fcresinin azalt\u0131lmas\u0131 veya faaliyetin tamamen veya k\u0131smen\ndurdurulmas\u0131 ile sonu\u00e7lanan d\u0131\u015fsal etkilerden kaynaklanan d\u00f6nemsel durumlar\u0131 ya\nda deprem, yang\u0131n, su bask\u0131n\u0131, heyelan, salg\u0131n hastal\u0131k, seferberlik gibi\ndurumlar\u201d<\/em> olarak tarif edilmi\u015f, <strong>salg\u0131n\nhastal\u0131k<\/strong> a\u00e7\u0131k\u00e7a zorlay\u0131c\u0131 sebepler aras\u0131nda say\u0131lm\u0131\u015ft\u0131r. Bu kapsamda\nya\u015famakta oldu\u011fumuz Covid-19 salg\u0131n\u0131 nedeni ile i\u015f\u00e7inin i\u015fe gidememesinin; i\u015f\nakdinin \u0130\u015f Kanunu\u2019nun 25\/III Maddesi uyar\u0131nca i\u015fveren taraf\u0131ndan hakl\u0131 nedenle feshi\ni\u00e7in zorlay\u0131c\u0131 sebepler kapsam\u0131nda yer alaca\u011f\u0131 a\u00e7\u0131kt\u0131r. <\/p>\n\n\n\n<p><strong>3.3.2. Covid-19 Neticesinde Zorlay\u0131c\u0131 Nedene Ba\u011fl\u0131 Fesih Uygulamas\u0131 <\/strong><\/p>\n\n\n\n<p>\u0130\u015f\u00e7i yukar\u0131da izah\nedildi\u011fi \u00fczere zorlay\u0131c\u0131 sebeple (\u00d6rn: soka\u011fa \u00e7\u0131kma yasa\u011f\u0131 veya karantina gibi\nnedenlerle i\u015f\u00e7ilerin bir haftadan fazla i\u015fe gidememesi) i\u015fe gidemeyebilecektir.\nZorlay\u0131c\u0131 nedenlerin bir haftadan fazla s\u00fcrmesi halinde i\u015fveren i\u015f akdini hakl\u0131\nnedenle feshedebilecektir. <\/p>\n\n\n\n<p>\u00d6ncelikle i\u015fe\ngidilemeyen bir hafta boyunca i\u015f s\u00f6zle\u015fmesi ask\u0131da kalacak, i\u015fveren <a href=\"https:\/\/www.lexpera.com.tr\/mevzuat\/kanunlar\/is-kanunu-4857\/madde-40\">\u0130\u015f Kanunu 40<\/a>.\nMaddesi uyar\u0131nca bu s\u00fcrede i\u015f\u00e7iye her g\u00fcn i\u00e7in yar\u0131m \u00fccret \u00f6demek durumunda\nkalacakt\u0131r. Bir hafta sonunda i\u015fveren hakl\u0131 nedenle fesih hakk\u0131n\u0131\nkullanabilecek veya bu hakk\u0131n\u0131 kullanmayacak, i\u015f s\u00f6zle\u015fmesi zorlay\u0131c\u0131 sebep\nortadan kalkana dek ask\u0131da kalmaya devam edecektir. Bu s\u00fcrede i\u015fverenin \u00fccret\n\u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc bulunmayacakt\u0131r.<a href=\"#_ftn10\">[10]<\/a><\/p>\n\n\n\n<p><strong>3.3.3. Covid-19 Neticesinde Zorlay\u0131c\u0131 Nedene Ba\u011fl\u0131 Feshin Sonu\u00e7lar\u0131<\/strong><\/p>\n\n\n\n<p>\u0130\u015f S\u00f6zle\u015fmesi\u2019nin i\u015fveren taraf\u0131ndan hakl\u0131 nedenle\nfeshi halinde di\u011fer hakl\u0131 nedenle fesih durumlar\u0131ndan farkl\u0131 olarak, i\u015f\u00e7i k\u0131dem\ntazminat\u0131na ili\u015fkin di\u011fer \u015fartlar\u0131 da ta\u015f\u0131yor olmak \u015fart\u0131 ile k\u0131dem tazminat\u0131na\nhak kazanacakt\u0131r. <\/p>\n\n\n\n<p>Bunun yan\u0131 s\u0131ra &nbsp;Covid-19 salg\u0131n\u0131 sebebiyle yap\u0131lacak fesih, \u0130\u015f Kanunu\u2019nun\n25.maddesi kapsam\u0131nda zorlay\u0131c\u0131 sebep say\u0131laca\u011f\u0131ndan ve yine bu maddelerdeki\nh\u00fck\u00fcmler do\u011frultusunda feshin <em>\u2018\u2019s\u00fcrenin bitiminden \u00f6nce veya bildirim\ns\u00fcresini beklemeksizin\u2026\u2019\u2019<\/em>&nbsp;yap\u0131laca\u011f\u0131 hususu nazara al\u0131nd\u0131\u011f\u0131nda,\nCovid-19 salg\u0131n\u0131 zorlay\u0131c\u0131 sebebi kapsam\u0131nda i\u015f s\u00f6zle\u015fmesi feshedilen i\u015f\u00e7i\nihbar tazminat\u0131na hak kazanamayacakt\u0131r. <\/p>\n\n\n\n<p><strong>3.3.4. 7244 Say\u0131l\u0131 Kanun\u2019un Zorlay\u0131c\u0131 Nedenle \u0130\u015f Akdinin Feshine Etkisi<\/strong><\/p>\n\n\n\n<p>\u00c7al\u0131\u015fmam\u0131n 3.1. k\u0131sm\u0131nda da yer verdi\u011fim \u00fczere 7244 Say\u0131l\u0131 Kanun\u2019un <strong>\u201c<\/strong><em>Bu Kanunun kapsam\u0131nda olup olmad\u0131\u011f\u0131na bak\u0131lmaks\u0131z\u0131n her t\u00fcrl\u00fc i\u015f veya hizmet s\u00f6zle\u015fmesi, bu maddenin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten itibaren \u00fc\u00e7 ay s\u00fcreyle 25 inci maddenin birinci f\u0131kras\u0131n\u0131n (II) numaral\u0131 bendinde ve di\u011fer kanunlar\u0131n ilgili h\u00fck\u00fcmlerinde yer alan ahlak ve iyi niyet kurallar\u0131na uymayan haller ve benzeri sebepler d\u0131\u015f\u0131nda i\u015fveren taraf\u0131ndan feshedilemez.\u201d <\/em>y\u00f6n\u00fcndekiGE\u00c7\u0130C\u0130 10. MADDES\u0130 ile i\u015f\u00e7inin i\u015f akdinin,&nbsp; ahlak ve iyi niyet kurallar\u0131na uymayan haller ve benzeri sebepler d\u0131\u015f\u0131nda bu kanunun y\u00fcr\u00fcrl\u00fc\u011f\u00fc girdi\u011fi tarih itibari ile 3 ay s\u00fcre ile feshedilmesi yasaklanm\u0131\u015ft\u0131r. <strong>Bu nedenle 17.04.2020 tarihinden itibaren 3 ay s\u00fcre ile i\u015fverenin \u0130\u015f Kanunu\u2019nun 25\/III. Maddesi uyar\u0131nca i\u015f akdini feshetmesi s\u00f6z konusu olamayacak bu tarihten \u00f6nce bu sebeple ger\u00e7ekle\u015ftirilen fesihler ge\u00e7erlili\u011fini koruyacakt\u0131r. <\/strong><\/p>\n\n\n\n<p><strong>3.4. Covid-19 Salg\u0131n\u0131 Sebebi ile Uzaktan \u00c7al\u0131\u015fma <\/strong><\/p>\n\n\n\n<p>Salg\u0131n\u0131n etkisini g\u00f6stermeye ba\u015flad\u0131\u011f\u0131 g\u00fcnden bu yana i\u015fverenler,\nhem i\u015f\u00e7ilerin sa\u011fl\u0131\u011f\u0131 hem de i\u015fletmenin i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi i\u00e7in i\u015f\u00e7ilerin\nevden \u00e7al\u0131\u015fmas\u0131 y\u00f6n\u00fcnde kararlar almaktad\u0131rlar. Hem i\u015fin y\u00fcr\u00fct\u00fclmesi hem de\ni\u015f\u00e7ilerin ma\u011fdur olmamas\u0131 ad\u0131na, yap\u0131lmakta olan i\u015fin buna elveri\u015fli olmas\u0131 halinde\nverilecek olan en makul kararlardan biri uzaktan \u00e7al\u0131\u015fma y\u00f6ntemine ge\u00e7i\u015f\nyap\u0131lmas\u0131d\u0131r. Hal b\u00f6yle olunca bu \u00e7al\u0131\u015fma t\u00fcr\u00fcne ili\u015fkin esaslar\u0131n belirlenmesi\nve i\u015fverenin bu y\u00f6nde bilgilendirilmesi olduk\u00e7a \u00f6nem arz kazanm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Uzaktan \u00e7al\u0131\u015fma sistemi 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 14. Maddesinin\n4.f\u0131kras\u0131nda d\u00fczenlenmi\u015f, <\/p>\n\n\n\n<p>\u201c<em>i\u015f\u00e7inin, i\u015fveren taraf\u0131ndan olu\u015fturulan i\u015f organizasyonu\nkapsam\u0131nda i\u015f g\u00f6rme edimini evinde ya da teknolojik ileti\u015fim ara\u00e7lar\u0131 ile\ni\u015fyeri d\u0131\u015f\u0131nda yerine getirmesi esas\u0131na dayal\u0131 ve yaz\u0131l\u0131 olarak kurulan i\u015f\nili\u015fkisidir.\u201d&nbsp; <\/em>olarak tan\u0131mlanm\u0131\u015ft\u0131r<em>. <\/em>Yine ayn\u0131 maddenin\n5. F\u0131kras\u0131nda i\u015f\u00e7inin yapaca\u011f\u0131 \u00e7al\u0131\u015fmaya ili\u015fkin t\u00fcm esaslar\u0131n, i\u015fin tan\u0131m\u0131n\u0131n\ngenel ve \u00f6zel t\u00fcm \u015fartlar\u0131n a\u00e7\u0131k\u00e7a belirlenmesi gerekti\u011fi hususu\nvurgulanm\u0131\u015ft\u0131r.<a href=\"#_ftn11\">[11]<\/a><\/p>\n\n\n\n<p>Kanun maddesinden, uzaktan\n\u00e7al\u0131\u015fma y\u00f6nteminin benimsendi\u011fi s\u00f6zle\u015fmelerin yaz\u0131l\u0131 yap\u0131lmas\u0131 gerekti\u011fi hususu\na\u00e7\u0131k\u00e7a anla\u015f\u0131lmaktad\u0131r. Yine ayn\u0131 \u015fekilde uzaktan \u00e7al\u0131\u015fan i\u015f\u00e7iler ile di\u011fer\n\u00e7al\u0131\u015fan i\u015f\u00e7iler aras\u0131nda bir ayr\u0131m yap\u0131lamayaca\u011f\u0131, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi\nkonusunda da yeterli bilgilendirmenin kendisine yap\u0131lmas\u0131n\u0131n gerekti\u011fi,\ni\u015fverenin ana y\u00fck\u00fcml\u00fcl\u00fcklerinin bu s\u00f6zle\u015fme tipinde de varl\u0131\u011f\u0131n\u0131 korudu\u011fu\n\u00f6zellikle belirtilmi\u015ftir.<a href=\"#_ftn12\">[12]<\/a><\/p>\n\n\n\n<p>Bu bilgiler \u00e7er\u00e7evesinde\nya\u015famakta oldu\u011fumuz bu salg\u0131n sebebi ile uzaktan \u00e7al\u0131\u015ft\u0131r\u0131lacak olan i\u015f\u00e7inin bu\nesaslara uygun olarak \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 gerekti\u011fi a\u00e7\u0131kt\u0131r. Bu maddede say\u0131lan\nesaslar\u0131n ve s\u00f6zle\u015fmeye ili\u015fkin \u015fekil \u015fartlar\u0131n\u0131n yan\u0131 s\u0131ra; i\u015f\u00e7i uzaktan\n\u00e7al\u0131\u015fmaya ge\u00e7i\u015f yapaca\u011f\u0131 i\u00e7in \u00e7al\u0131\u015fma ko\u015fullar\u0131nda esasl\u0131 bir de\u011fi\u015fikli\u011fe\ngidilmesi de s\u00f6z konusu olacakt\u0131r ve buna ili\u015fkin d\u00fczenlemelere de uyulmas\u0131\ngerekecektir.<\/p>\n\n\n\n<p>&nbsp;4857 Say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 22. Maddesi uyar\u0131nca\ni\u015f\u00e7inin \u00e7al\u0131\u015fma ko\u015fullar\u0131nda esasl\u0131 de\u011fi\u015fikli\u011fe gidilecek olmas\u0131 halinde bu\nhususun i\u015f\u00e7iye yaz\u0131l\u0131 olarak bildirilmesi ve 6 i\u015f g\u00fcn\u00fc i\u00e7inde i\u015f\u00e7inin yaz\u0131l\u0131\nolarak bu teklife cevap vermesi gerekmektedir. \u0130\u015f\u00e7inin bu teklifi yaz\u0131l\u0131 kabul\netmesi veya, itiraz etmeksizin \u015fartlar\u0131 kabul ederek \u00e7al\u0131\u015fmaya devam halinde i\u015f\ns\u00f6zle\u015fmesi yeni ko\u015fullar\u0131 ile varl\u0131\u011f\u0131n\u0131 s\u00fcrd\u00fcrmeye devam edecektir. <\/p>\n\n\n\n<p>Mevcut duruma bak\u0131ld\u0131\u011f\u0131nda, salg\u0131n nedeni ile\nyaz\u0131l\u0131 bir s\u00f6zle\u015fme ili\u015fkisi kurulamadan veya \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131n\nde\u011fi\u015fikli\u011fine ili\u015fkin yaz\u0131l\u0131 onay al\u0131nmadan uzaktan \u00e7al\u0131\u015fma sistemine ge\u00e7i\u015f yap\u0131ld\u0131\u011f\u0131\ng\u00f6r\u00fclmektedir. Burada yap\u0131lmas\u0131 gereken husus \u00f6ncelikle bu \u015fartlar\u0131n yerine\ngetirilmesidir. Ancak i\u015fin aciliyeti gere\u011fi bu \u015fartlar\u0131n yerine getirilememesi\nhalinde de Yarg\u0131tay\u2019\u0131n \u00e7al\u0131\u015fma ko\u015fullar\u0131ndaki de\u011fi\u015fikli\u011fi kabul ederek\n\u00e7al\u0131\u015fmaya devam eden i\u015f\u00e7inin bu ko\u015fullar\u0131 z\u0131mnen kabul etti\u011fine ili\u015fkin <a href=\"#_ftn13\">[13]<\/a>&nbsp; kararlar\u0131 da g\u00f6z \u00f6n\u00fcnde bulundurularak bir\nde\u011ferlendirme yap\u0131lmas\u0131 gerekti\u011fi kanaatindeyim. <\/p>\n\n\n\n<p>Burada uzaktan \u00e7al\u0131\u015fma\ny\u00f6ntemine ge\u00e7ilmesindeki temel ama\u00e7 i\u015f\u00e7inin korunmas\u0131d\u0131r. \u0130\u00e7inde bulundu\u011fumuz\nsalg\u0131n tehlikesinin zorlay\u0131c\u0131 bir sebep meydana getirmesinden hareketle,\nnormalde yaz\u0131l\u0131 akdedilmesi gereken bu s\u00f6zle\u015fmelerin s\u00f6zl\u00fc olarak yap\u0131lmas\u0131\nveya i\u015f\u00e7iden \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131n de\u011fi\u015fikli\u011fine ili\u015fkin yaz\u0131l\u0131 onay\nal\u0131namamas\u0131n\u0131n d\u00fcr\u00fcstl\u00fck kural\u0131 ve iyi niyet ilkesiyle birlikte de\u011ferlendirilmesi\ngerekmektedir. <\/p>\n\n\n\n<p>Burada \u00fczerinde durulmas\u0131 gereken ba\u015fka bir husus da i\u015f\u00e7inin bu durumu kabul etmeyerek fiili olarak bu \u015fekilde \u00e7al\u0131\u015fmaya ba\u015flamamas\u0131 halidir. \u0130\u015f\u00e7i \u00e7al\u0131\u015fma ko\u015fullar\u0131ndaki bu de\u011fi\u015fikli\u011fi kabul etmek zorunda de\u011fildir. Bu durumda i\u015fveren 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 18. Maddesi uyar\u0131nca i\u015f akdinin ge\u00e7erli nedenle feshedebilecektir. \u0130\u015f\u00e7i bu durumda di\u011fer ko\u015fullar\u0131n da varl\u0131\u011f\u0131 halinde k\u0131dem ve ihbar tazminat\u0131na hak kazanacakt\u0131r. <\/p>\n\n\n\n<p><strong>3.5. Covid-19 Salg\u0131n\u0131 ve K\u0131sa \u00c7al\u0131\u015fma <\/strong><\/p>\n\n\n\n<p>\u0130\u015f kanunumuzda bir d\u00fczenlemeye dayanmayan k\u0131sa\n\u00e7al\u0131\u015fma, hukuki dayana\u011f\u0131n\u0131 4447 Say\u0131l\u0131 \u0130\u015fsizlik Sigortas\u0131 Kanunu\u2019nun Ek 2. maddesinden\nalmaktad\u0131r. Bu madde h\u00fckm\u00fc gere\u011fince; genel ekonomik, sekt\u00f6rel,\nb\u00f6lgesel kriz veya zorlay\u0131c\u0131 sebeplerle i\u015fyerindeki haftal\u0131k \u00e7al\u0131\u015fma\ns\u00fcrelerinin ge\u00e7ici olarak en az \u00fc\u00e7te bir oran\u0131nda azalt\u0131lmas\u0131 veya s\u00fcreklilik\nko\u015fulu aranmaks\u0131z\u0131n i\u015fyerinde faaliyetin tamamen veya k\u0131smen en az d\u00f6rt hafta\ns\u00fcreyle durdurulmas\u0131 halleri k\u0131sa \u00e7al\u0131\u015fma olarak kabul edilmi\u015f ve i\u015fyerinde \u00fc\u00e7\nay\u0131 a\u015fmamak \u00fczere sigortal\u0131lara \u00e7al\u0131\u015famad\u0131klar\u0131 d\u00f6nem i\u00e7in k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011finden\ngelir deste\u011fi sa\u011flanaca\u011f\u0131 ve genel sa\u011fl\u0131k sigorta primlerinin \u00f6denece\u011fi h\u00fck\u00fcm\nalt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Yukar\u0131da da izah etti\u011fimiz \u00fczere sosyal ve \u00e7al\u0131\u015fma hayat\u0131n\u0131 durdurma noktas\u0131na getiren bu salg\u0131n hastal\u0131k nedeni ile bir\u00e7ok i\u015f\u00e7i ve i\u015fveren zor durumda kalm\u0131\u015ft\u0131r. Bu ma\u011fduriyetlerin giderilmesi ad\u0131na i\u015fyerindeki \u00e7al\u0131\u015fmalar\u0131n\u0131 ge\u00e7ici olarak tamamen veya haftal\u0131k \u00e7al\u0131\u015fma s\u00fcrelerinin en az \u00fc\u00e7te bir oran\u0131nda durdurmu\u015f olan i\u015fverenin, \u015fu anda uygulamada ba\u015fvurabilece\u011fi en makul yol k\u0131sa \u00e7al\u0131\u015fma ve k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011fi olarak g\u00f6z\u00fckmektedir. <\/p>\n\n\n\n<p><strong>3.5.1. K\u0131sa \u00c7al\u0131\u015fma \u00d6dene\u011finden Faydalan\u0131lmas\u0131na \u0130li\u015fkin \u015eartlar<\/strong><\/p>\n\n\n\n<p><strong>3.5.1.1. Genel Ekonomik, Sekt\u00f6rel veya B\u00f6lgesel Kriz \u0130le Zorlay\u0131c\u0131 Sebeplerin Varl\u0131\u011f\u0131<\/strong><\/p>\n\n\n\n<p>K\u0131sa \u00c7al\u0131\u015fma uygulamas\u0131na ge\u00e7ilmesi i\u00e7in \u00f6ncelikle\nekonomik, sekt\u00f6rel, b\u00f6lgesel bir kriz veya zorlay\u0131c\u0131 nedenlerin varl\u0131\u011f\u0131\naranmaktad\u0131r. Covid-19 y\u00f6n\u00fcnden bir de\u011ferlendirme yapt\u0131\u011f\u0131m\u0131zda, bu salg\u0131n\nhastal\u0131\u011f\u0131n zorlay\u0131c\u0131 neden olarak kabul edilece\u011fi K\u0131sa \u00c7al\u0131\u015fma Y\u00f6netmeli\u011fi\u2019nin\nm. 3\/f. 1-h<a href=\"#_ftn14\">[14]<\/a>\nbendinde h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015f olup, yukar\u0131da ayr\u0131nt\u0131l\u0131 olarak salg\u0131n hastal\u0131\u011f\u0131n\nzorlay\u0131c\u0131 sebep olarak kabul edilip edilemeyece\u011fi irdelenmi\u015ftir. <\/p>\n\n\n\n<p><strong>3.5.1.2. \u0130\u015fyerinde \u00c7al\u0131\u015fman\u0131n Tamamen veya K\u0131smen Durmas\u0131 ya da \u00c7al\u0131\u015fma S\u00fcrelerinin \u00d6nemli \u00d6l\u00e7\u00fcde Azalmas\u0131<\/strong><\/p>\n\n\n\n<p>K\u0131sa \u00c7al\u0131\u015fma uygulamas\u0131na ge\u00e7ilmesi i\u00e7in bir di\u011fer \u015fart olarak, yap\u0131lmakta olan i\u015fin k\u0131smen veya tamamen durdurulmas\u0131d\u0131r. Burada i\u015fin k\u0131smen durmas\u0131 halinde \u00e7al\u0131\u015fman\u0131n en az \u00fc\u00e7te bir oran\u0131nda azalt\u0131lmas\u0131 ve her iki durumda bu durumun ge\u00e7ici olmas\u0131 gerekmektedir. K\u0131sa \u00e7al\u0131\u015fma nedenleri\u00adnin varl\u0131\u011f\u0131na ra\u011fmen azalt\u0131lm\u0131\u015f \u00e7al\u0131\u015fma s\u00fcreleri uygulamas\u0131n\u0131n ge\u00e7ici de\u011fil de s\u00fcrekli olmas\u0131 halinde haftal\u0131k \u00e7al\u0131\u015fma s\u00fcrelerinin \u00f6nemli \u00f6l\u00e7\u00fcde azalt\u0131ld\u0131\u011f\u0131 s\u00f6ylenemeyece\u011fi i\u00e7in k\u0131sa \u00e7al\u0131\u015fmadan da bahsedilemeyecektir. Bu s\u00fcre\u00e7te \u00e7al\u0131\u015fma s\u00fcresi y\u00f6n\u00fcnden de bu \u015fart\u0131n sa\u011flanmas\u0131 gerekmektedir. <a href=\"#_ftn15\">[15]<\/a><\/p>\n\n\n\n<p><strong>3.5.1.3. Bu kapsamda bu s\u00fcre\u00e7te h\u00fck\u00fcmet\ntaraf\u0131ndan yeni bir d\u00fczenleme yap\u0131\u015ft\u0131r: <\/p>\n\n\n\n<p>&nbsp;4447 Say\u0131l\u0131 \u0130\u015fsizlik Sigortas\u0131 Kanunu&#8217;na eklenen ge\u00e7ici 23. maddesi\nkapsam\u0131nda;&nbsp; <\/p>\n\n\n\n<p>30 Haziran 2020&#8217;ye kadar ge\u00e7erli olmak \u00fczere, yeni tip koronavir\u00fcs (Kovid-19) kaynakl\u0131 zorlay\u0131c\u0131 sebep gerek\u00e7esiyle yap\u0131lan k\u0131sa \u00e7al\u0131\u015fma ba\u015fvurular\u0131 i\u00e7in, i\u015f\u00e7inin k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011fine hak kazanabilmesi i\u00e7in \u00f6ng\u00f6r\u00fclen hizmet akdinin feshi hari\u00e7 i\u015fsizlik sigortas\u0131 hak etme ko\u015fullar\u0131n\u0131 yerine getirmesi h\u00fckm\u00fc, k\u0131sa \u00e7al\u0131\u015fma ba\u015flama tarihinden \u00f6nceki son 60 g\u00fcn hizmet akdine tabi olanlardan son \u00fc\u00e7 y\u0131l i\u00e7inde 450 g\u00fcn sigortal\u0131 olarak \u00e7al\u0131\u015f\u0131p i\u015fsizlik sigortas\u0131 primi \u00f6denmi\u015f olmas\u0131 \u015feklinde uygulanacakt\u0131r. Bu ko\u015fulu ta\u015f\u0131mayanlar, k\u0131sa \u00e7al\u0131\u015fma s\u00fcresini ge\u00e7memek \u00fczere son i\u015fsizlik \u00f6dene\u011fi hak sahipli\u011finden kalan s\u00fcre kadar k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011finden yararlanmaya devam edecektir ve k\u0131sa \u00e7al\u0131\u015fma uygulamas\u0131ndan yararlanabilmek i\u00e7in i\u015fyerinde k\u0131sa \u00e7al\u0131\u015fma uygulanan d\u00f6nemde, i\u015fveren taraf\u0131ndan i\u015f\u00e7ilerin i\u015f akitlerine son verilemeyecektir. <\/p>\n\n\n\n<p><strong>3.5.2. K\u0131sa \u00c7al\u0131\u015fma \u00d6dene\u011finin S\u00fcresi ve Bu S\u00fcre\u00e7te \u0130\u015f\u00e7inin Sigortal\u0131l\u0131k Durumu<\/strong><\/p>\n\n\n\n<p>K\u0131sa \u00c7al\u0131\u015fma Y\u00f6netmeli\u011fi\u2019nin 7\/2. maddesinde, k\u0131sa\n\u00e7al\u0131\u015fma s\u00fcresinin \u00fc\u00e7 ay\u0131 a\u015fmamak \u00fczere k\u0131sa \u00e7al\u0131\u015fma s\u00fcresi kadar olaca\u011f\u0131\nd\u00fczenlenmi\u015ftir. Zorlay\u0131c\u0131 sebeplerle i\u015fyerinde k\u0131sa\n\u00e7al\u0131\u015fma yap\u0131lmas\u0131 halinde, \u00f6demeler 4857 say\u0131l\u0131 Kanunun 24 \u00fcnc\u00fc maddesinin\n(III) numaral\u0131 bendinde ve 40 \u0131nc\u0131 maddesinde \u00f6ng\u00f6r\u00fclen bir haftal\u0131k s\u00fcreden\nsonra ba\u015flayacakt\u0131r. Bu bir haftal\u0131k s\u00fcrede i\u015fveren i\u015f\u00e7inin yar\u0131 \u00fccretini\n\u00f6demeye devam edecektir. <\/p>\n\n\n\n<p>Yasal d\u00fczenleme gere\u011fi bu bir haftal\u0131k\ns\u00fcre\u00e7te i\u015f\u00e7i yar\u0131m \u00fccrete hak kazanmakta olup kanun koyucu m\u00fckerrer bir \u00f6demeye\nsebebiyet vermemek amac\u0131yla k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011finin bu bir haftal\u0131k s\u00fcrenin ge\u00e7mesinin\nard\u0131ndan yap\u0131lmas\u0131n\u0131 \u00f6ng\u00f6rm\u00fc\u015ft\u00fcr.<a href=\"#_ftn16\">[16]<\/a><\/p>\n\n\n\n<p>Bu s\u00fcre\u00e7te i\u015f\u00e7inin sigortal\u0131l\u0131k durumu\ni\u015fin k\u0131smen veya tamamen durdurulmas\u0131na g\u00f6re farkl\u0131l\u0131k g\u00f6stermektedir. \u0130\u015fin tamamen\ndurdurulmas\u0131 halinde \u0130\u015f\u00e7inin k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011fi ald\u0131\u011f\u0131 s\u00fcre i\u00e7in, 31.5.2006\ntarihli ve 5510 say\u0131l\u0131 Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanunu\ngere\u011fi \u00f6denecek sigorta primi, \u0130\u015fsizlik Sigortas\u0131 Fonu taraf\u0131ndan Sosyal\nG\u00fcvenlik Kurumuna aktar\u0131l\u0131r. T\u00fcrkiye \u0130\u015f Kurumu\u2019nun uygulamas\u0131 bu y\u00f6ndedir.<\/p>\n\n\n\n<p>\u0130\u015fin tamamen durdurulmad\u0131\u011f\u0131 hallerde ise, i\u015f\u00e7iye kendisine ba\u011flanan k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011fi d\u0131\u015f\u0131nda \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u00fcrelere ili\u015fkin olarak i\u015fveren taraf\u0131ndan \u00fccret yat\u0131r\u0131lacakt\u0131r. K\u0131sa \u00c7al\u0131\u015fman\u0131n Sona Ermesi <\/strong><\/p>\n\n\n\n<p>K\u0131sa \u00e7al\u0131\u015fma,K\u0131sa \u00c7al\u0131\u015fma Y\u00f6netmeli\u011fi\u2019nin 7\/2. Maddesinde\nbelirlenen 3 ayl\u0131k s\u00fcrenin dolmas\u0131, 3 ayl\u0131k s\u00fcre dolmaks\u0131z\u0131n k\u0131sa \u00e7al\u0131\u015fmaya\nsebebiyet veren durumun ortadan kalkmas\u0131 veya k\u0131sa \u00e7al\u0131\u015fmaya ba\u015fvuran i\u015fverenin\ntek tarafl\u0131 uygulamay\u0131 neticelendirmesi ile bu uygulama sonlanabilecektir.<\/p>\n\n\n\n<p>Bu pandemi s\u00fcrecinde de i\u015fverenin k\u0131sa \u00e7al\u0131\u015fma s\u00fcrecine ge\u00e7mesi halinde 3 ayl\u0131k s\u00fcrenin dolmas\u0131, bu salg\u0131n hastal\u0131k s\u00fcrecini sona ermesi veya i\u015fverenin bu uygulamay\u0131 sona erdirmeye karar vermesi ile k\u0131sa \u00e7al\u0131\u015fma uygulamas\u0131 son bulabilecektir. <\/p>\n\n\n\n<p><strong>4. SONU\u00c7 <\/strong><\/p>\n\n\n\n<p>Yukar\u0131da, d\u00fcnya \u00e7ap\u0131nda ya\u015fanmakta olan Covid-19 salg\u0131n\u0131n\u0131n i\u015f\ns\u00f6zle\u015fmeleri \u00fczerindeki etkileri incelenerek, i\u015fverenin bu s\u00fcre\u00e7te izleyebilece\u011fi\nyollar irdelenmi\u015ftir.
